TERMS OF SERVICE

ARTISTIC FREEDOM:

<sup>- I am SFW ARTIST
- I am an ARTISTIC FREEDOM ARTIST.
- Flexing my creative muscles usually bring out my best work & I have several happy customers who tell me so.
- If you are super picky, I am not the artist for you.
- Just let me know what is important and what has wiggle room regarding your character commission.
- If you are still interested, read on!</sup>

ORDERING PROCESS:

<sup>- Order forms are provided for the offered commission types through buttons here on my site, so just click!
- If the form says closed/full, then I may be closed for the time being. Try back later or email me to inquire.
- If the form is open, simply fill out and submit your form and I will receive your request via email.
- Form sections should be kept as brief and concise as possible as lengthy descriptions are unwelcome for being overwhelming, confusing and tedious to decipher.
- I will reply to your order via email as soon as I can. And once approved I will send your invoice over paypal or stripe.
- All commission discussion, including changes and edits, must be in reply to the original email/form for the commission
(You should always receive a copy of your order form via email).
No correspondence over discord or any other sites is official. I need the info all in one place (the email) to avoid mistakes or missing or changed info.
- Unless it is an in-stream commission or a silhouette icon, you should receive a WIP (work in progress) to approve before the completion of your commission. (Be sure to review the WIP carefully as any changes later will cost you extra!)
- Completed commissions will be delivered via the contact email you provide me in your forms the moment I complete them.
- Be sure to SAVE YOUR COMPLETED COMMISSIONED ARTWORK! as I cannot guarantee that I will have the file forever (loss of data on my end for example).</sup>

PAYMENT:

<sup>- I only accept payment through PAYPAL (Paypal allows you to pay with your debit/credit cards too!) or STRIPE (PREFERRED cuz less fees and you don't even need a stripe account as stripe allows you to pay with a debit card, a gift card, a prepaid card, or you can link your PayPal to a Google pay account and pay a stripe invoice that way!)
- I must receive payment in full before I can begin work!
- I only accept USD (United States Dollars).
- I do NOT accept echecks, or snail mail.
- All sales are final once payment has been received. (See Refunds Section for more)
- Tips (through ko-fi) are always welcome and appreciated!
- Never send payment without my approval because it will be considered a tip or donation and you will not be refunded!</sup>

PRICING:

<sup>- Prices are subject to change at any time.
- Prices are usually outlined on my homepage and within the order forms.
- Only the artist can worth their art. Arguing my pricing will get you nowhere but it will get you blocked.
- I may also charge more for your commission if you have an overly complex character, or want any extras not normally included in a commission (which is usually an option to check off in my commission order forms).

UPDATED: ETAS & COMMISSION PRIORITY:

<sup>- ETAs are estimates, not guarantees.
- Estimated time for commission completion depends on my current queue or if I have a large project going on at the time. If you would like, you can contact me for an estimate.
- Delays happen. (Technical difficulties, or mental or physical health - my carpal tunnel -, finances, etc.) Look out for my "Jasmae Updates" which usually outline current or owed commissions, what's going on, updated ETAs, etc.
-IF YOU NEED YOUR COMMISSION BY A CERTAIN DATE, YOU MUST LET ME KNOW UP FRONT AND IT MAY BE SUBJECT TO AN ADDITIONAL "RUSH" FEE IF I ACCEPT YOUR REQUEST.
- The quickest way to get a commission is to catch a stream where I take and complete commissions during the stream to get things on and off my plate immediately.

COMMISSION QUEUE PRIORITY ORDER:
0. STREAM AND SEASONAL COMMISSIONS
1. REGULAR COMMISSIONS
2. EMERGENCY / FLASH SALE COMMISSIONS
3. PERSONAL ART & ART TRADES-REGULAR COMMISSIONS queue has top priority.
-Regular commissions are commissions that are ordered anytime I am open for commissions which are not part of a stream, seasonal, emergency or flash sale.
-Regular commissions are completed in order they are paid for.-STREAM AND SEASONAL COMMISSIONS take temporary priority (Stream commissions during streams and seasonal during seasonal sales such as halloween, xmas, vday with limited slots) and afterwards regular commissions resume top priority.-EMERGENCY / FLASH SALE COMMISSIONS (Such as my SKETCH SALE COMMISSIONS queue) are commissions ordered with the communicated agreement before ordered of a slow turnaround.
-These are secondary priority. This means that I work on them less often than the regular commissions queue. I make time during the week to knock out a few and even work on some in my personal art time.-PERSONAL ART & ART TRADES are still important to me. BECAUSE ARTISTS ARE PEOPLE, NOT MACHINES.
I've neglected this for so long, but in order to improve, I need to take a little time for myself to practice and study experiment. This is done in my personal time and doesn't take away from my commission work time.

REVISIONS:

<sup>- It is your responsibility to tell me everything I need to know in order to complete your commission upon your commissioning me. I will of course ask questions if I feel I need more information, but know that this is your responsibility to inform me accordingly.
- If you failed to inform me of a mistake or change to your commission before or during the optional sketch approval, it is your fault and I am not responsible for fixing it.
- You must pay me for any changes, but I may not always be willing to accept them. (This includes custom designs and adopts!)
- Revision costs are dependent on the amount of work it will take to complete.
- If you are unhappy with my interpretation of what you described, that is also not my fault and I will not redo it because you had a vision you could not convey.
- You are not allowed to edit my artwork. (See Use of Artwork section)</sup>

REFUNDS:

- Remember that all sales are final once payment has been received.
I may however, refund you if I am unable to complete your commission for any reason on my end.
- You can cancel your commission before payment is sent.
- If you are being a finicky or picky customer and continually ask me to change things about your commission, or are continually uncooperative, I may wish to give you a partial refund and may no longer wish to work with you.
- If you ask for a refund because you are suddenly scared you are being ripped off because another artist did that to you before, that is unfair, rude and I may no longer wish to work with you. And you still probably wont get the refund. So if you are not an understanding or patient person, please look elsewhere.

REFERENCE IMAGES:

^{- Reference Images are required to complete your commission for most commission types.

- 2 images (maximum!) per character.
- Additional references are only permitted if you need an outfit, body type, hair, tattoo, or accessory reference (unless it is already included in the first 2 images of your character).UNACCEPTABLE:*No ADULT as I am NOT an adult artist! - No exceptions! Failure to comply will result in declining your commission immediately and possibly blocking you. WHEN IN DOUBT, ASK BEFORE YOU SEND NSFW IMAGES !!!Q: What is adult?
A: If it is intended to arouse, If they are spread, erect, wet,
bent over, lactating, sex-faced, masturbating, or having sex, etc. IT IS ADULT AND I DO NOT WANT TO SEE IT.- NO!!! - Character image galleries. I can't study numerous images of your character to decipher what the differences are between each image and what is and isn't correct. Please select the 2 most relevant and just tell me in a few words anything else I need to know.
- NO!!! - Written descriptions in place of image ref (unless previously discussed or in the case of silhouette Icons as they do not require an image. A description of species, gender, body type is doable).
- NO!!! - STA.SH DeviantArt wants me to sign in as you and I can't obviously, so I can't view the references. Feel free to reply to the order form email with attached refs though!

WILLS & WONTS:

USE OF ARTWORK:

<sup>All Rights Reserved.
- Do not redistribute, claim, copy, trace, edit, or use my artwork in any way without permission.</sup>- My artwork is copyright to me. You are not allowed to use my artwork by any means without my permission!- Only the commissioner of a piece of artwork may re-upload the work.
The commissioner may also, if desired, use the work as part of a ref or crop it for an icon.- You are not allowed to edit my art in any way without my permission!- Only sketch commissions may be colored by the commissioner.
If you would like another person/artist to color your sketch commissions, PLEASE ASK ME FIRST!- You must always credit me when re-posting or using any of my art!- You are not allowed to use my art for commercial use without my proven consent and signed agreement. Contact me for licensing.- I am allowed to sell prints or other merchandise of any artwork I create if I so choose.- Violations to this Terms of Service Agreement will result in Artist Beware / Commissioners Beware, etc. and you will be added to my perma-blacklist.

Adoptable character designs:

- You need permission first if adopting on behalf of or for someone else.- You may resell for the same price you got the design.
You can raise the price to include the equal cost of commissioned art of the character.- You may not sell a design you got for free or won in a raffle, but you can trade them with others or give away for free.- Small changes to the design are acceptable as long as the design is still recognizable to the original and you do not edit the original artwork.- You can of course change the name, gender, species of the adopt as long as it adheres to the above statement and does not infringe on any other person’s original species rules.- All sales of designs are final. If you get buyer's remorse often, don't impulse buy things!- Violation of agreement means I reclaim the design and may resell or reuse, even without a refund.- See Use of Artwork for re-uploading permissions! And please enjoy my designs!

Auctions:

AUCTIONS MAY BE HELD FOR ADOPTABLE CHARACTER DESIGNS AND/OR YCHS- Always follow rules on the auction submission itself!- Never hide or retract your bids, even if you make a mistake. I will hide them if necessary. If you retract your bid without notice, you will be suspended/banned from the next or all future auctions.- If outbid, you are no longer obligated to pay me anything once the auction has ended, even if the person who outbid you broke the rules and retracted their bid.- In the event that the winner breaks the rules and retracts their bid or cannot pay, I will ask the runner up if they’d like to purchase at their last bid price, but they may decline.
Auctions always end on the date listed, but 15 minutes after the last bid in the event of last second bids.- If any problems arise with your paypal, etc., feel free to inform me but I cannot guarantee that I wont suspend/ban you from at least the next auction.- Payment is due within 24 hours of me notifying you for winning, unless otherwise discussed beforehand.
If you fail to pay within this time and without notice, I will offer the prize to the next person or restart the auction.- Auction may be cancelled, postponed, or extended in the event of no bids in the first 24 hours or breaking the rules with retracted bids.

Silhouette Icon FAQ

Can I get a larger resolution file?Icons are created at 300 x 300 ppi
You will receive the full 300 x 300 ppi (600 x 300 for couples, etc.) and a 100 x 100 ppi version of your icons.
I cannot make icons larger AFTER created.
If you need to request a larger size, please ask me prior to ordering, as it will require approval and additional fee.Have you started my icon yet?Icons are either not started or completed as I do not stop part way through an icon when I go to work on it. They are a quicker commission type and I usually do a bunch in one sitting.Can I see a WIP / sketch of my icon?Due to silhouette style / my art process, there are no WIPs or sketches to be seen before I begin work.Can I get a revision / redo?As per my tos, revisions may be subject to a fee.I can make small adjustments to an icon, but all the elements in the icon are dependent upon each other for the overall effect. (Some parts are transparent!)Therefore, no major changes (such as a change in pose) is really possible without a complete do-over.In most cases, you'll need to purchase a new icon for a redo (I'll give you a discount of course).Can I change my character(s)?As long as I have not started, of course!! Contact me with the new character (s) and details for the commission!Will I receive my icon(s) before halloween?[ This question is regarding my Annual Halloween Icons ]That's the plan!
